This privacy policy (the “Privacy Policy”) describes our practices and policies with regards to how we collect, use, and disclose your information provided to us through your visit to our website at, and the use of our services, including the SmartEdPad Tablet Solution, SmartEdApp Software Solution, and the SmartEd App (collectively the “Services”). The applications, including the applications owned by us or applications owned by third parties, are referred to as the “App(s)”. We refer to SPED K12, Inc., with its affiliates, “SPED K12” “we” “our” “us” or the “Company”. We refer to those who visit our website and those who use our Services as “you” “your” “or “User(s)”.Our Services may be used by children under the age of 13 upon verifiable consent from the parent or legal guardian, however our Services can be purchased by individuals over the age of 18 (the “you” “your” or “Purchaser(s)”). Together with our End-User License Agreement (“EULA”), this Privacy Policy governs both the Users and Purchasers use of our Services.

We are committed to the protection of your privacy. Keeping your information secure and confidential is a critical part of our business.

We NEVER rent, sell or trade your personal information to anyone.

Information We Collect Upon Purchase of our Service(s)

“Personal Information” is your personally identifiable information such as your name, email or mailing address, phone number, account credentials, account numbers and any other identifier that we gather from your use of our website, our Services, or through communications with representatives of SPED K12.

In order to use our Services you will be required to include:

  • Name
  • Email address
  • Mailing address
  • Phone number
  • Credit card information (for any applicable purchases)

This collection of information applies to the Purchasers of Services, however we do not collect Personal Information from children under the age of 13, or our Users.

Additional Information We Collect While You Use our Services

We use Mixpanel, a third party tool in our SmartEdApp Table or Software Solution(s), to track usage of our Users. The list of actions that we track in our SmartEdApp Tablet or Software Solution(s) are the following:

  • App Started
  • App Installed
  • App Uninstalled
  • App Updated
  • Button Clicked

These actions are tracked based on the User registered identification number (which is the applicable email address), and device identification.

How We Use and Disclose Your Personal Information

We may use and disclose your Personal Information only as follows:

  • To promote use of our Services. For example, if you leave your Personal Information with us when you visit our Website and don’t sign up for any of our Services, we may send you an email asking whether you want to sign up. And if you use any of our Services, and we think you might benefit from using another Service we offer, we may send you an email telling you about it. You may opt-out from any email marketing.
  • To send you administrative emails regarding our Services. For example, we may let you know about temporary or permanent changes to our Services, such asplanned outages, new features, version updates, releases, abuse warnings, and changes to our Privacy Policy.
  • To enforce compliance with our EULA and applicable laws. This may include developing tools and algorithms that help us prevent violations.
  • To provide customer support.For example, to respond to inquiries, and/or other requests or questions.
  • To protect the rights and safety of our Purchasers, Users and third parties, as well as our own.
  • To share information with others based on your consent.
  • To meet legal requirements such as complying with court orders and valid subpoenas.
  • To provide information to representatives and advisors, such as attorneys and accountants, to help us comply with legal, accounting, or security requirements.
  • To prosecute and defend a court, arbitration, or similar proceeding.
  • To support and improve the Services we offer. This includes adding features that compare Members’ Campaigns, or using data to suggest other publishers your subscribers may be interested in.
  • To communicate with you about your account for informational, not promotional, reasons.
  • To transfer your information in the case of a sale, merger, consolidation, or acquisition. In that event, any acquirer will be subject to our obligations under this Privacy Policy, including your rights to access and choice. We will notify you of the change either by sending you an email or posting a notice on our Web site.


We allow the following advertising features: Remarketing with Google AdSense, and Google Display Network Impression Reporting. We use these to compile data regarding User interactions with ad impressions, and other service functions as they relate to our website.

However, we do not let third parties, including our ad networks or plug-ins collect Personal Information from children under the age of 13, or our Users.

Our Cookie Policy

Cookies are pieces of information stored directly on the computing device you are using. Cookies we use do not contain or capture Personal Information. Cookies allow us to collect information such as your browser type, time spent on our web sites and which of our pages you visited.

We use the information for to compile aggregate data about our website traffic and website interactions in order to offer a better browsing experience on our website for our Users. Third Party Services

We may use third party service providers to help us analyze certain online activities. For example, these service providers may help us measure the performance of our online promotions or analyze Site activity. We do not share any personal information about our customers with these third party service providers, and these service providers do not collect such information on our behalf.

We use third party vendor(s) who are PCI compliant for storing and processing Credit card information. We do not store sensitive financial information, including Credit card information, on our servers. In addition, our website is security with Secure Socket Layer (SSL), which is an encryption technology designed to protect your transmitted data.

Reviewing and Updating your Personally Identifiable Information

You can view and update the profile and account information we collect for you by going to the “[settings]” function in the applicable application. The credibility and relevance of our services depend on your providing us with complete, accurate and up-to-date information about yourself and your accounts, both now and in the future.

Email Marketing Opt-out

When we communicate our own marketing offers to you, these communications are CAN-SPAM compliant, including the ability for you to opt-out of marketing communications.

Protecting Children’s Privacy Online

SPED K12 is used by individuals under the age of thirteen (13), however we do not collect Personal Information from those children, and those children should not provide Personal Information through our websites or through the use of our Services in any way. We do not knowingly collect Personal Information from children under 13 without verifiable parental consent.

Modifications to our Privacy Policy

Any information that is collected is subject to the privacy policy in effect at the time such information is collected. We may, however, modify and revise our privacy policy from time to time.
